Migrant who pushed man onto Tube tracks was in process of appealing deportation for sex crimes

A migrant was appealing deportation for a series of sex crimes when he pushed a man in front of a train.

Brwa Shorsh, 24, shoved Tadeusz Potoczek, 61, into the path of an oncoming Tube train at Oxford Circus station, in central London, on Feb 3.

He denied trying to kill him, but admitted he did it for “revenge” because the postman gave him a “dirty look”.

It has now emerged that Shorsh had a number of convictions for assault and indecent acts, but stalled a bid by the Home Office to deport him by lodging an appeal with the immigration tribunal service.

Shorsh had been sleeping rough and had committed several offences since arriving in Britain in 2019.

A previous immigration tribunal hearing heard he had shown a ”pattern of regular serious offending” and had 12 convictions for 21 offences, including assaults, anti-social behaviour and outraging public decency”.

Deportation appeal

His appeal against deportation was still ongoing when he pushed Mr Potoczek in front of the southbound Victoria Line train.

Another passenger responded immediately, pulling Mr Potoczek back onto the platform with seconds to spare and the postman did not sustain any serious injuries.

Robert Walker, the train’s experienced train driver, spotted Mr Potoczek, who was wearing a bright red jacket, and hit the emergency brake.

Shorsh left the station and he was arrested by an officer, who recognised him from the CCTV images collected, just hours later at Warren Street station at around 10.30pm.

The Kurdish migrant denied attempted murder, but was convicted by a jury after 32 minutes deliberation at Inner London Crown Court on July 31. He is due to be sentenced on September 26.

One source told The Sun newspaper: “His appeal was still ongoing when he pushed the victim off the platform onto the tracks at Oxford Circus. It makes you wonder what exactly you have to do to be deported from the UK?”

The Home Secretary has a legal duty to deport foreign criminals. This applies to non-British, non-Irish nationals sentenced to at least 12 months imprisonment for a criminal offence in the UK, with certain exceptions. There is also ministerial discretion to deport foreign nationals if it is considered “conducive to the public good”.

A House of Commons Library report earlier this month showed that in 2023, just under 4,000 foreign offenders were removed from the UK. This was the highest number in four years, but lower than pre-pandemic levels. From 2010 to 2019, removals averaged 5,500 per year.

‘Angry’ at women laughing

Shorsh had told his trial he was “angry” after three women allegedly laughed at him for being homeless and he felt Mr Potoczek had given him a dirty look and had been “very disrespectful to me”.

Oliver Matthews, the commuter who came to Mr Potoczek’s rescue, said in a statement read to the court: “I was very shocked and I rushed over to the platform.

“I took hold of [Mr Potoczek] and pulled him back onto the platform. I situated myself between them to make sure that [Shorsh] didn’t try anything else.”

Mr Walker, the train driver, said in a statement to the court: “I was shaken very badly by this. If he had been on the track a few seconds later, he would have been killed. Also, if I had looked away for a few seconds he would have been killed. I am very glad I managed to stop the train.”

If the Immigration Tribunal determines that Shorsh can be deported by the Home Office for his previous offences he could be sent to Kurdistan - which is understood to be his country of origin - if the region is deemed safe enough. The FCO currently advises against all but essential travel to the area.

The Home Office said it would not comment on individual cases and it would be inappropriate to comment on ongoing legal proceedings.
